Terms of Service · Effective 27 October 2026

Terms for responsible vehicle work.

These TrakarIA Terms of Service govern access to the TrakarIA website, applications, vehicle workspaces, public presentations, APIs and related services supplied by TRAKARIA LLC. They form the product-use agreement between TRAKARIA LLC and the person or organisation using TrakarIA.

By creating an account, accepting an order or using the service, you agree to these Terms. If you act for an organisation, you confirm that you have authority to bind it. Mandatory rights that cannot lawfully be limited continue to apply.

Read the Terms
01

Your workspace, your responsibility

You control authorised users, lawful instructions, customer content and the operational decisions made from the workspace.

02

Human review remains required

Vehicle, document and AI-assisted outputs must be checked before they support a public, commercial, safety or legal decision.

03

Clear service boundaries

Plans, credits, integrations, availability, liability limits and enforcement rights are defined below so that use remains predictable.

Terms of Service

Agreement and operator

TRAKARIA LLC ('TrakarIA', 'we', 'us') provides the TrakarIA product and licenses its use. You may contact us at contact@trakaria.com. These Terms apply together with any accepted order form, plan description, applicable product-specific terms, the Privacy Policy and the Refund Policy.

For a purchase processed by Paddle, Paddle's buyer terms govern the sale and payment transaction, while these Terms govern access to and use of the TrakarIA product. If documents conflict, an individually signed order form controls the commercial scope it expressly changes; mandatory law and Paddle's transaction terms continue to control their respective subject matter.

Product supplier

TRAKARIA LLC supplies, operates and supports the TrakarIA software product.

Transaction provider

Paddle acts as authorised reseller and merchant of record for purchases it processes.

Eligibility and authority

You must have legal capacity to enter into this agreement. If you use TrakarIA for a company or another organisation, that organisation is responsible for your use and you represent that you are authorised to accept these Terms for it.

You must provide accurate account and billing information, keep it current and use the service only where legally permitted. We may refuse registration, require reasonable verification or restrict an account where information is incomplete, misleading, sanctioned, high-risk or inconsistent with the service's intended use.

Organisation administrators

Administrators control invitations, roles, workspace settings and the removal of access. Their instructions bind the organisation within the service.

Individual users

A person using TrakarIA directly remains responsible for the legality, accuracy and consequences of their own inputs and sharing choices.

Accounts and access

Each user must use their own authorised access. You are responsible for protecting credentials, devices, API keys and recovery methods, and for notifying us promptly of suspected compromise. Actions performed through an account may be treated as authorised until we receive sufficient notice of misuse.

You may not share credentials, sell access, evade plan limits or create accounts to bypass a restriction. We may apply authentication, rate, device, organisation and abuse controls, and may require a password reset or revoke sessions where reasonably necessary to protect the service.

Security duties

Use strong credentials, appropriate roles and prompt offboarding. Keep local copies of information that your operation cannot afford to lose.

Report misuse promptly

Contact support as soon as you suspect unauthorised access, exposed credentials or activity that could affect another person or organisation.

Service and licence

Subject to these Terms and the applicable plan, TrakarIA grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to access the hosted service for your lawful personal or internal business vehicle workflows during the active service period.

The service is licensed, not sold. No ownership in the software, models, interfaces, documentation, trademarks or underlying technology transfers to you. Features may differ by plan, workflow, region, language, account type, release stage or technical compatibility.

Permitted scope

Use the features and capacity included in the active plan for genuine vehicle-related work.

Plan limits

Vehicle, user, credit, storage, API, support and publication limits may be technically enforced.

Plans, trials and renewal

A new organisation may receive ten days of access to released Pro capabilities without providing a payment card. Unless a paid plan is deliberately purchased, the workspace moves to the available Free plan when the trial ends; the trial itself does not create a charge.

Paid subscriptions renew for successive billing periods until cancelled. The checkout, order confirmation or accepted order states the plan, price, currency, billing period and taxes. Cancellation stops a future renewal but does not normally reverse the current period or create a refund. Upgrades may take effect after payment; downgrades normally take effect at the next renewal.

Ten-day Pro trial

No card is required to start. Trial access may be limited to one genuine trial per person, organisation or related workspace.

Recurring subscription

A paid plan continues and is charged by Paddle for each billing period until cancellation takes effect.

Prospective plan changes

We may change future plan contents or prices with notice appropriate to the change and applicable law. A current paid period is not shortened solely by a prospective downgrade.

Paddle, payments and taxes

Paddle is the authorised reseller and merchant of record for transactions processed through Paddle. The buyer purchases the subscription or other paid entitlement from Paddle, and Paddle handles checkout, payment collection, applicable transaction taxes, receipts, subscription payment administration and monetary refunds.

You authorise Paddle to charge the payment method shown at checkout for recurring charges when applicable. Prices on our public pricing page are stated in USD and exclude applicable taxes unless expressly shown otherwise. Currency conversion, payment-method availability and tax calculation can depend on buyer location and Paddle's checkout.

Paddle Buyer Terms

Paddle's buyer terms apply to the purchase transaction and identify the relevant Paddle contracting entity.

Credits, capacity and add-ons

Monthly plan credits refresh at the billing cycle and unused monthly credits do not roll over. Purchased T credits do not expire while the account remains active, but they have no cash value, are not legal tender, cannot be transferred outside the account and do not unlock a capability excluded from the plan.

Extra vehicles, users or other recurring add-ons are billed at the price shown when added and may renew with the subscription. Usage is measured by our service records. We may correct evident metering errors, prevent artificial consumption patterns and restrict attempts to resell, pool or exploit credits outside their intended product function.

Included monthly credits

Refresh each cycle, do not roll over and are consumed before separately purchased credits where the product indicates.

Purchased credits

Remain available on an active account, but are non-transferable, have no cash value and are subject to the Refund Policy and mandatory law.

Included processing

Where the pricing page identifies an AI operation as included, that operation does not debit T credits; fair-use and abuse controls still apply.

Customer content and instructions

You retain rights in content you lawfully submit. You grant TrakarIA and its processors a worldwide, non-exclusive licence to host, copy, transform, transmit and display that content only as needed to operate, secure, support and improve the requested service, comply with your supported sharing choices and meet legal obligations.

You are responsible for having the rights, notices, permissions and lawful basis needed for vehicle records, photographs, documents, signatures, customer or driver information and every publication instruction. Do not upload unnecessary sensitive data. We may remove, quarantine or restrict content that appears unlawful, harmful, infringing, unsafe or inconsistent with these Terms.

Private workspace

Content is not made public merely because it is stored in a workspace.

Deliberate publication

An authorised user controls supported publication. Recipients may copy or redistribute an accessible output, which TrakarIA cannot recall from them.

Model training

Use of an AI-assisted feature does not by itself authorise TrakarIA to train its own models on identifiable customer content; separate recorded authorisation is required.

Read the Privacy Policy

AI and vehicle decisions

AI-assisted results, extracted values, descriptions, image edits, translations, damage suggestions and other generated outputs may be incomplete, inaccurate or unsuitable for a particular purpose. They are working material, not a certified inspection, valuation, legal opinion, safety decision or promise of commercial performance.

A competent person must review source evidence and validate any output before it affects a vehicle, customer, driver, employee, buyer, rental, maintenance action, claim, publication or other consequential decision. You remain responsible for the final decision and for any professional or regulatory review required in your market.

Check the source

Keep the original image, document or vehicle evidence available when accuracy matters.

No professional substitute

TrakarIA does not replace a mechanic, appraiser, insurer, lawyer, accountant, regulator or qualified safety professional.

Acceptable use

You must not use TrakarIA to break the law, violate another person's rights, misrepresent a vehicle, conceal a material defect, discriminate unlawfully, harass, defraud, distribute malware, compromise security, collect data without authority or create an unsafe or deceptive output.

You must not reverse engineer or copy protected parts of the service except where a non-waivable law expressly permits it; scrape or probe the service; bypass security, plan, rate or access controls; overload infrastructure; use automated access outside documented interfaces; benchmark for a competing product without written permission; or resell, lease or sublicense access unless an agreement expressly allows it.

Protective enforcement

We may investigate, preserve evidence, rate-limit, remove content, suspend access or cooperate with competent authorities where reasonably necessary.

Fair use of shared resources

High-volume, abusive or technically harmful use may be limited even where a numeric ceiling is not displayed.

API, integrations and webhooks

Documented APIs and webhooks may be used only for authorised integrations and within the active plan. Keep credentials secret, validate webhook signatures, design consumers to be idempotent, respect documented limits and reconcile important events through the supported API rather than treating one delivery attempt as a permanent system of record.

We may version, deprecate, limit or disable an integration to protect security, reliability, legal compliance or the product. Where practicable, we will provide reasonable notice of a material non-emergency deprecation. Third-party systems remain outside our control, and we do not guarantee their availability, compatibility or acceptance of an event.

Credential control

You are responsible for every request made with an issued credential until it is revoked or replaced.

Delivery is not a guarantee

Networks and receiving systems fail. Use retries, idempotency and reconciliation for operationally important events.

Published contract

Only documented, currently supported endpoints and event shapes form part of the public integration contract.

Read the integration documentation

Intellectual property and feedback

TrakarIA and its licensors retain all rights in the service, software, designs, models, documentation, trademarks and improvements. These Terms grant only the limited right to use the service; no implied licence is created.

If you voluntarily provide feedback or suggestions, you grant TRAKARIA LLC a perpetual, worldwide, irrevocable, royalty-free right to use and incorporate them without restriction or compensation, provided we do not publicly identify you as the source without permission.

Brand use

You may not imply endorsement, partnership or ownership of TrakarIA branding without written permission.

Rights complaints

Send a sufficiently detailed intellectual-property complaint to contact@trakaria.com so that we can assess it.

Availability, support and changes

The service is provided on an 'as available' basis. Maintenance, security work, supplier failures, network conditions, force majeure, preview features and product development may interrupt or change access. Unless a signed agreement states a specific service level, we do not promise uninterrupted operation, a response time, permanent availability of a feature or recovery within a particular period.

We may add, modify or discontinue features. We will not intentionally remove the core paid value of an active period without an appropriate remedy where required by law, but no plan guarantees that every interface, beta, AI model, third-party integration or incidental capability will remain unchanged.

Support scope

Support helps diagnose the TrakarIA service; it does not operate your business, validate your records or administer third-party systems.

Your continuity

Maintain exports, source evidence and independent procedures appropriate to the operational importance of your data.

Suspension and termination

You may stop using the service and cancel a paid subscription through the supported billing route. We may suspend or restrict access immediately where reasonably necessary for security, fraud prevention, legal compliance, non-payment, serious or repeated breach, harm to another person, infrastructure risk or protection of TrakarIA and its users.

We may terminate an account after material breach, persistent non-payment, unlawful use or withdrawal of the service. Where the circumstances allow, we may give notice and an opportunity to cure or export. Immediate action may be taken where delay would create risk. On termination, the licence ends; accrued payment obligations, protective clauses and provisions intended to survive remain effective.

Data after closure

Retention, export and deletion follow the active plan, supported closure process, Privacy Policy, legal holds and applicable law.

No evasion

A suspended or terminated user may not create or use another account to bypass the restriction.

Disclaimers

To the maximum extent permitted by law, TrakarIA is provided without express, implied or statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, availability or results. We do not warrant that the service will be error-free, secure against every threat or compatible with every system.

Vehicle information and generated outputs depend on the evidence, instructions and systems provided. We do not guarantee a vehicle's identity, condition, legality, safety, value, availability or history, nor any sale, rental, fleet, inspection, savings, revenue, compliance or customer outcome. Nothing in these Terms excludes a warranty or remedy that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, TRAKARIA LLC and its affiliates, personnel and suppliers are not liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for lost profits, revenue, business, opportunity, goodwill, anticipated savings or data, even if advised that such loss was possible.

To the maximum extent permitted by law, their total aggregate liability arising from or related to the service and these Terms is limited to the greater of the amount paid for TrakarIA during the twelve months preceding the event giving rise to the claim or USD 100. This cap applies across all claims and theories. It does not limit liability that applicable law forbids us to limit, including where relevant for fraud, wilful misconduct, gross negligence, death or personal injury.

Business allocation of risk

Business users agree that the pricing reflects these exclusions and limits and will maintain insurance and continuity controls appropriate to their operations.

Business-user indemnity

If you use TrakarIA for business purposes, you will defend, indemnify and hold harmless TRAKARIA LLC, its affiliates and personnel from third-party claims, losses, liabilities, damages and reasonable costs arising from your customer content, unlawful instructions, public outputs, breach of these Terms, violation of another person's rights or misuse of the service.

This obligation does not apply to the extent a claim is caused by TrakarIA's own breach, gross negligence or wilful misconduct. We may control the defence and settlement of a covered claim; you must cooperate and may not settle in a way that admits fault or imposes obligations on TrakarIA without written consent.

Law and disputes

Before filing a claim, contact contact@trakaria.com with enough detail for the parties to try to resolve it informally. Except where urgent relief or mandatory law requires otherwise, each party should allow thirty days for a good-faith resolution attempt.

These Terms are governed by the laws applicable to TRAKARIA LLC, without regard to conflict-of-law principles. To the extent legally permitted, disputes must be brought in the competent state or federal courts having jurisdiction where TRAKARIA LLC is established. Consumers retain any mandatory governing-law, venue and dispute rights available in their place of residence.

Changes and contact

We may update these Terms for legal, security, operational or product reasons. The effective date will change. Material changes will receive notice appropriate to their impact and applicable law. Changes normally apply prospectively; continued use after they take effect constitutes acceptance where the law permits.

If a provision is unenforceable, it will be limited to the minimum necessary and the remaining provisions continue. A failure to enforce a term is not a waiver. You may not assign this agreement without our written consent; we may assign it in connection with a reorganisation, financing, merger, acquisition or transfer of the service, subject to applicable law.

Before you evaluate TrakarIA

A few things worth knowing up front.

Who provides TrakarIA and who processes the payment?

TrakarIA LLC supplies and licenses the TrakarIA product. Paddle acts as authorised reseller and merchant of record for purchases it processes.

Can an AI-assisted TrakarIA result be used without review?

No. Vehicle, document and AI-assisted outputs must be checked by a competent person before a public, commercial, safety or legal decision.

What happens to a paid TrakarIA subscription after cancellation?

Cancellation normally stops the next renewal. Paid access generally continues to the end of the current period unless it is refunded or suspended under the Terms.

Can TrakarIA suspend an account immediately?

Yes, where immediate action is reasonably needed for security, fraud, non-payment, unlawful use, serious breach or protection of TrakarIA and its users.

Do purchased T credits unlock features outside my plan?

No. Purchased credits cover supported usage, have no cash value and do not unlock a capability excluded from the active plan.
